Attached is a Tax Advisory on Arkansas State & Local Tax Issues produced by the State Chamber/AIA Tax Committee Legal Council, Mike Parker, that should be of interest to you and/or your tax experts.
The update discusses two recent court decisions involving issues the State Chamber/AIA Tax Committee have been very involved in for a number of years. The first is a Circuit Court decision involving “The Property Taxpayer Bill of Rights,” claims for refund of property taxes paid on manufacturing inventories, and claims for refund of property taxes in general. The second is an Arkansas Supreme Court decision involving the definition of “equipment” for sales and use tax purposes. The latter decision is very helpful in “expanding the envelope” of items that can be classified as tax exempt manufacturing equipment rather than taxable supplies; but perhaps more important, recognizes and accepts that the Arkansas Legislature clarified (eased) all taxpayers’ burden of proof in state tax exemption cases by passing a bill the State Chamber/AIA Tax Committee wrote and lobbied in the 2009 Legislative Session.
